CheerLume User Agreement

Introduction

Welcome to CheerLume (the "App"). CheerLume is developed and operated by independent developer Liu Caiming ("we", "us").

This User Agreement (the "Agreement") is a binding agreement between you and us governing your use of the App. Please read it in full before using the App, paying particular attention to the passages shown in bold. By downloading, installing, launching or otherwise using the App, you confirm that you have read, understood and accepted this Agreement. If you do not agree to any part of it, please stop using the App and delete it from your device.

1. What the App Does

CheerLume is a handheld cheering tool for concerts, matches, gatherings and similar live settings. Its main features are:

• Light board — type the line you want to show, pick a theme and an effect, then hold your phone sideways and raise it as a handheld banner;
• Show tools — Flashlight, Glow Stick, Music Flash, Teleprompter, Scoreboard and Fill Light.

Every feature runs locally on your device and does not depend on any server operated by us. We may add, change or retire features through app updates.

2. Accounts and Devices

CheerLume has no account system. You do not need to provide a phone number, an email address or any personal identifier in order to use it.

To count how many times the free allowance has been used, the App generates a random device identifier and stores it in the system keychain on your device. This identifier contains nothing that identifies you personally and is never uploaded to any server. See our Privacy Policy for details.

3. Acceptable Use

You agree to comply with the laws of your jurisdiction and not to use the App to:

• display text or imagery that is unlawful, that endangers public or national security, or that disrupts public order;
• insult, defame, harass or threaten any person, or infringe anyone's reputation, likeness, privacy or intellectual property rights;
• display obscene, pornographic, violent, extremist, gambling- or drug-related content;
• display false information, unauthorised advertising or anything else likely to mislead the public;
• disrupt a performance, disturb public order, or interfere with other people's enjoyment of an event.

You are solely responsible for everything you type into and display through the App. Because the App works offline and uploads nothing, we have no way of knowing or reviewing what you choose to display. You bear full responsibility for any dispute, claim or liability arising from your content, and you agree to indemnify us for any loss we suffer as a result.

4. Intellectual Property

The App and everything in it — source code, interface design, icons, illustrations, themes, templates, effects and font resources — is owned by us or our respective licensors and is protected by copyright and other applicable laws.

Without our written permission you may not copy, modify, reverse engineer, decompile or disassemble the App, nor extract or redistribute any of its assets.

Text you write yourself remains yours. We claim no rights over it and neither collect nor use it in any way.

5. Paid Features

The core features of the App are free. Some features carry a free-usage limit, after which a subscription is required to continue.

Benefits, pricing, auto-renewal rules and refund policy are set out in the Membership Agreement. All payment, renewal and refund handling is carried out by Apple through the App Store.

6. Safety Notice and Disclaimer

Please also note:

• Do not stare directly at the screen at high brightness or at the flashlight for extended periods, as this may cause eye discomfort or injury;
• Do not use the App while driving, operating machinery, or doing anything else that requires your full attention;
• Do not shine bright light into another person's eyes — particularly drivers, children or performers;
• Many venues have specific rules about lighting devices and phone use. Please check and follow the rules of the venue you are attending. You are responsible for the consequences of breaching them;
• Sustained high screen brightness or flashlight use drains the battery quickly and makes the device warm. This is normal; please use the App sensibly.

To the fullest extent permitted by law, we are not liable for indirect, incidental or consequential loss, or loss of profit, arising from your use of or inability to use the App. The App is provided "as is" and we do not warrant that it will be entirely free of errors or interruptions.

7. Changes and Termination

We may revise this Agreement in response to changes in law or to the product. The revised version will be published on this page and takes effect on publication. Continuing to use the App after a change means you accept it; if you do not, please stop using the App.

You may terminate this Agreement at any time by deleting the App. We may terminate your access if you materially breach this Agreement.

8. Governing Law and Disputes

This Agreement is governed by the laws of the mainland of the People's Republic of China, excluding its conflict-of-laws rules.

Any dispute should first be addressed through good-faith negotiation. If that fails, either party may bring proceedings before the competent court at our place of domicile.
